Prostitutes in portions of Canada may soon be able to solicit clients openly
without having to dodge the cops.
Arguing that current laws endanger more than protect prostitutes,
Ontario Superior Court Judge Susan Himel yesterday struck down all three
criminal provisions -- pimping, operating a "common bawdy house," and
communicating for the purposes of prostitution -- that had been challenged by
two former prostitutes and a female sadomasochist.
"By increasing the
risk of harm to street prostitutes, the communicating law is simply too high a
price to pay for the alleviation of social nuisance," Himel stated in her
ruling. "I find that the danger faced by prostitutes greatly outweighs any harm
which may be faced by the public."
